    After reviewing the historical backdrop of the case law analyzing an account debtor’s right of setoff/recoupment after improper payment (following receipt of notice of assignment) by the account debtor to the assignor, this program will examine two 2016 unpublished federal district court cases that support an account debtor’s right of setoff/recoupment. Then, this program will consider practical strategies for avoiding an account debtor’s ability to successfully argue setoff/recoupment.

Instructor:

    David S. Pokela received his B.S. degree from the University of North Carolina in 1987 and his J.D. degree from Wake Forest University in 1992 where he was a member of the Wake Forest Law Review and the Moot Court Board. Mr. Pokela concentrates his legal practice in the areas of commercial litigation (including the representation of factoring companies), appellate litigation, real estate litigation and land use litigation. He has previously served as a member of the Land Use Section Council of the North Carolina Bar Association. He also previously served as a member of the Real Property Section Council of the North Carolina Bar Association, in which he served as the Chairman of the Section’s Real Property Litigation Committee.
