Protecting Factors of Health Care Receivables Webinar with Andrew E. Bluestein and Robert Del Giorno

The health care industry is subject to complex laws, rules and regulations, many of which prohibit business practices that are generally accepted (and the norm) in other industries.  In addition, federal and state governments, as well as commercial insurance companies, have invested millions of dollars to detect and combat health care fraud and abuse.  As a result of the complex rules and significant enforcement activities, factoring of health care receivables presents significant risks to Factors and their investments to help ensure that the receivables are not subject to recoupment by the government and other payors.  In addition, Factors need take steps to help mitigate against accusations of having financed fraudulent conduct of a health care provider.

  • A beginner to intermediate level discussion on the most important health care laws and regulations relating to Factoring of health care receivables;
  • The basic risks of Factoring health care receivables;
  • Strategies that can be employed by Factors to mitigate risks.

Instructor:

Andrew Blustein is a Partner, Director and Vice Chairman of Garfunkel Wild, P.C.  Mr. Blustein is a member of the firm’s Health Care, Business, and Compliance and White Collar Defense practice groups. He is the Chair of both the Health Care and Information Technology Practice Group and the Insurance Regulatory Practice Group.  Mr. Blustein and members of his firm advise Factors on a variety of transactions, including helping Factors conduct an appropriate level of due diligence in the factoring of health care provider receivables.  Mr. Blustein has been honored by New York Super Lawyers - Metro Edition (2010-2015) and as a member of the Leading Lawyers List by The Ambulatory M&A Advisor (2014).   He graduated from Vassar College (B.A., Phi Beta Kappa, cum laude) in 1987 and Benjamin N. Cardozo School of Law (J.D., magna cum laude) in 1990.

Robert Del Giorno is a Partner of Garfunkel Wild and a member of the firm’s Compliance and White Collar Defense Group, Health Care Group and the Litigation & Arbitration Group.  Mr. Del Giorno has significant experience representing health care providers in connection with federal and state criminal and civil investigations involving health care fraud.  He assists Factors and other financial institutions in developing and executing due diligence reviews of health care providers.  Mr. Del Giorno attended Fairfield University where he graduated in 1998 with a B.A. in Economics.  He received his law degree from St. John's University School of Law, cum laude, in 2002.
