Factoring State and Federal Governmental Receivables

This webinar addresses key legal issues that factors [and asset-based lenders] need to consider when deciding whether to offer factoring or asset-based lending facilities to businesses that sell goods or services to state and federal governmental units, which issues include: sovereign immunity, the Federal Assignment of Claims Act, State regulations governing the assignment of claims, the application of Article 9 of the Uniform Commercial Code to transfers made by state government units, mandatory pre-litigation contract dispute procedures and more. We will discuss an actual collection lawsuit that a factor brought against a state governmental unit account debtor to collect accounts, and how to overcome numerous defenses that the state government unit account debtor raised against the factor to seek to prevent the factor from collecting the accounts.
